Nothing about the COVID-19 vaccine is simple, nor black-and-white, and as far as employers making employees take the vaccine with job implications on the line as well, it is a tightrope worth navigating. myFM has been tackling this issue all week long talking with the health unit and a GTA legal expert and today we come closer to home and talk with local Lawyer Andrea Bezaire from Strathroy’s Bezaire Hemeryck Barnett firm who says there are definitely competing interests at play.
Bezaire says that in the case of a rights impasse, that goes over the employer’s head as far as workplace safety being a proverbial trump-card.
She does warn however that not all information found on social media platforms is accurate.
Bezaire explained that there are no black-and white answers in law as a whole, and this scenario is no exception. As for the logistics of the vaccine’s implementation, Bezaire explains that if an employee says they can’t take the vaccine for a specific reason, the employer has a right to verify that claim.
