Peterborough City Council has withdrawn its intention to designate 1400 Monaghan Rd. as a heritage property under the Ontario Heritage Act (OHA).
The decision followed an objection filed by representatives of the property owner during the 30-day objection period that began on October 1st. Under the OHA, Council must consider objections to heritage designations before deciding whether to proceed or withdraw its notice of intention to designate (NOID).
The NOID for 1400 Monaghan Rd., known as The Martin House, was initially approved by Council on September 23rd, based on the property’s cultural heritage value. However, changes introduced through Bill 23 in 2022 shifted the review process, requiring municipal councils to assess objections before referring cases to the Ontario Land Tribunal (OLT).
With the withdrawal of the NOID, the property will be removed from the Heritage Register, and the City will notify the owner and publish a notice of its decision. If Council had chosen to proceed with the designation, a by-law would have been passed, triggering a second objection period and potential review by the OLT.
